FFA Affiliate TOS

Effective Date: January 1, 2026

These Terms of Service (“Agreement”) govern your participation in the Flat Fee Advertising (“FFA,” “Company,” “we,” “us,” or “our”) Affiliate Program (“Program”). By submitting an application or participating in the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by all terms, conditions, and policies set forth herein.

1. Program Enrollment & Account Eligibility
Free Participation: Enrollment in the FFA Affiliate Program requires zero upfront fees, zero starter kit purchases, and zero mandatory subscription costs.

Eligibility: You must be at least 18 years of age and legally capable of entering into binding contracts to participate.
Account Information: You agree to provide accurate, complete, and updated information during the registration process, including payout details and tax documentation where required.

Independent Contractor Status: Participation in this Program does not create an employer-employee relationship, agency, joint venture, or franchise partnership. You operate purely as an independent business entity or contractor.

2. Referral Tracking & Commissions
Commission Structure: Commissions are earned on valid, paid purchases made by prospective clients referred directly through your unique tracking link or assigned referral credentials.

One-Time Lead Reports: 30% commission per sale ($44.10 payout on a $147.00 report sale).
Monthly Subscriptions: 30% recurring monthly commission per active subscriber ($149.10 payout per active month on a $497.00/month subscription).

Tracking & Attribution: Leads and sales are tracked via your dedicated affiliate dashboard. Commissions are attributed on a first-touch or last-click attribution basis determined by our system cookies and tracking software.

Recurring Payout Requirements: Recurring commissions remain active only for as long as the referred client maintains an active, paid monthly subscription. If a client cancels, refunds, or defaults on payment, recurring commissions for that account immediately cease.

3. Payment Terms
Payout Schedule: Commissions are calculated on a monthly cycle and disbursed via the payment methods supported in your affiliate dashboard (e.g., Direct Deposit, PayPal).

Refunds & Chargebacks: If a referred client requests a refund, disputes a charge, or incurs a chargeback, FFA reserves the right to deduct the corresponding commission amount from your pending or future earnings.
Tax Responsibility: You are solely responsible for all federal, state, local, or international taxes owed on commissions earned through the Program.

4. Permitted Marketing Practices & Conduct
Approved Marketing: You may market FFA services using our plug-and-play marketing materials, approved email templates, call scripts, social media assets, and PDF flyers provided in your affiliate portal.

B2B Outreach: Marketing efforts must target legitimate commercial entities, business owners, and local service providers (e.g., commercial insurers, CPAs, web designers, signage providers).

Free Sample Distribution: You are authorized to offer potential clients approved free sample reports to demonstrate value.

5. Prohibited Activities
Violation of any of the following rules will result in immediate termination of your affiliate account and forfeiture of accrued, unpaid commissions:

No Spam / Unsolicited Mass Communications: You must strictly comply with the CAN-SPAM Act and local privacy regulations. Unsolicited commercial emails sent to purchased lists or mass auto-scraped personal addresses are strictly prohibited.

No Deceptive Advertising: You may not make false promises, earnings guarantees, or misleading claims regarding FFA lead reports or potential financial outcomes.

No Self-Referrals: You cannot use your own affiliate tracking link to purchase reports or subscriptions for your own businesses to generate commission kickbacks.

No Trademark Infringement / Brand Bidding: You may not bid on “Flat Fee Advertising,” “FFA,” or any variation of our trademarked terms in pay-per-click (PPC) search engine ad campaigns without prior written approval.

No High-Pressure Tactics: Marketing must adhere to professional B2B standards. Aggressive, manipulative, or coercive sales behavior is forbidden.

6. Intellectual Property
Limited License: FFA grants you a non-exclusive, non-transferable, revocable license to use our brand assets, logos, and promotional materials solely for promoting FFA services under this Agreement.

Data Protection: Data contained within FFA New Business Reports remains the exclusive intellectual property of FFA. Affiliates may not scrape, resell, or distribute raw report data outside of authorized free sample distribution.

7. Term & Termination
Termination at Will: Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.
Termination for Breach: FFA reserves the right to terminate your account immediately without notice if you breach any term of this Agreement.

Post-Termination Earnings: Upon termination due to a violation of Section 5, all rights to pending or future commissions are immediately revoked. If terminated without cause, accrued balance payouts will be settled during the next standard payout cycle.

8. Limitation of Liability & Disclaimers
No Earnings Guarantees: While the FFA program provides a 30% commission model, individual affiliate earnings depend entirely on personal sales activity, local market demand, and retention. FFA makes no explicit guarantee of financial earnings or income tiers.

Service Availability: FFA provides access to tracking dashboards, materials, and reports on an “as-is” and “as-available” basis. We are not liable for temporary service interruptions, system maintenance, or third-party tracking delays beyond our reasonable control.

Maximum Liability: To the maximum extent permitted by applicable law, FFA shall not be liable for indirect, incidental, or consequential damages arising out of your participation in the Program.

9. Amendments
FFA reserves the right to modify or update these Terms of Service at any time. Notice of changes will be communicated via email or posted directly within your affiliate dashboard. Continued participation in the Program following notice constitutes acceptance of the updated terms.

10. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which FFA is registered, without regard to its conflict of law principles. Any legal disputes arising under this Agreement shall be resolved through binding arbitration or within the appropriate state or federal courts of said jurisdiction.

By registering for and continuing to participate in the FFA Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms of Service.
